TEXT MESSAGING TERMS AND CONDITIONS:

Your use of this INSP text message service (the “Service”) constitutes your agreement to these terms and conditions (“Text Messaging Terms & Conditions”). Our website Terms and Conditions (“Website Terms and Conditions”) and Privacy Policy also apply to your use of the Service. We may amend these Text Messaging Terms & Conditions and modify or cancel the Service or any of its features without notice. We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your mobile operator. Message and data rates may apply.

By agreeing to these Text Messaging Terms & Conditions, authorizing us to contact you, and requesting to receive additional information from INSP, you are giving your express written consent under all applicable laws, including without limitation the Telephone Consumer Protection Act (47 U.S.C. § 227 et seq.), and the related FCC regulations as amended from time to time, to be contacted by INSP and its affiliates via text message.  INSP and its affiliates provide alerts, information, promotions, specials, and other marketing offers via text messages through your wireless provider to the mobile number you provided. You will receive recurring messages. You may need to confirm your consent, such as by following the instructions contained in an initial text message we send. Messages may be sent using an automatic telephone dialing system and using SMS technology. You understand that consent to receive such text messages is not required as a condition of purchasing any goods or services.

You agree to provide us with a valid mobile number at which you are consenting to receive text messages.  You represent and warrant that you are permitted to receive text messages at the mobile number you provide us, that you have full authority to consent to receive text messages at the mobile number you provide us, and that the mobile number you provide us is your own number and not someone else’s number. If you change your mobile number, you agree to opt out of the Services prior to changing your mobile number.  In addition, you agree to notify us in writing at INSP, LLC, 3000 Worldreach Drive, Indian Land, SC 29707, Attn: Digital Content and Social Media Department, whenever you stop using a particular mobile number you have provided to us.

By signing up for SMS, you agree to receive recurring special offers and marketing text messages. Messages may be sent using an automatic telephone dialing system. Consent to receive text messages is not required as a condition of any purchase. Text STOP to 694677 to cancel at any time. You will receive a one-time opt-out text message. For more information, send HELP to  694677 or text 877-354-3564. The wireless carriers are not liable for delayed or undelivered messages.

None of our employees is authorized to receive a verbal revocation of this consent to receive text messages or to execute a verbal request you may make to opt-out.

The mobile operators participating in this campaign include, but are not limited to AT&T, Sprint, Virgin Mobile, T-Mobile (T-Mobile is not liable for delayed or undelivered messages), MetroPCS (GSM), U.S. Cellular, and Verizon Wireless. If your mobile operator is not participating, you will not receive a reply to your messages. Some operators may not support some services at the process offered. Pre-paid users may not be able to participate. Please check with your mobile operator.

You must be the mobile account holder and at least 18 years old or have a parent or guardian’s permission to participate.

Your use of the Service constitutes your agreement to these Text Messaging Terms & Conditions and our Website Terms and Conditions.  This Agreement shall be governed by, and interpreted, construed, and enforced in accordance with, the Federal Arbitration Act and other applicable federal law. To the extent state law applies to any aspect of these Terms, or to any disputes and claims that are related to the Text Messaging Terms & Conditions, the law of the State of North Carolina will govern. If for any reason any portion of these Text Messaging Terms & Conditions is determined by a court of competent jurisdiction to be invalid or unenforceable, the rest of the Text Messaging Terms & Conditions shall remain in effect.

You agree to indemnify, defend, and hold us harmless from any third-party claims, liability, damages or costs arising from your use of the Service or from you providing us with a phone number that is not your own or that you stopped using but did not alert us in writing that you had stopped using. You agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service; any errors in such information; or any action you may or may not take in reliance on the information or service.

DISPUTES SUBJECT TO BINDING ARBITRATION:  You agree that any dispute you have with us or with our affiliates regarding any text message sent after your acceptance of these Text Messaging Terms & Conditions shall be resolved by binding individual arbitration pursuant to the rules of the American Arbitration Association, and you expressly waive the right to seek arbitration on a class rather than an individual basis.  Based on said waiver, you agree that the arbitrator shall have no authority to award relief on a class basis or to certify any class.  Finally, you agree that this arbitration agreement shall be governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq.
